i have a commission from an artist of a charictor that's copyrighted to me  but the artist is on the DNP list. would i be able to upload it?

No, you would not.

fchan.mees creator copyright. Mostly because it is the standard, and how it is near impossible to copyright a character.

Even if you owned a trademark on a character, fchan would still abide by the standard DNP convention of copyright ownership belongs to the creating artist, their legal representative, or in rare cases, when rights have been transferred, the same for that individual(s).

Meh. I've always been surprised people will pay for a commission that doesn't grant the commissioner certain rights. I expect the artist may want to maintain a certain influence (for example, no commercial use maybe) but I would expect to be granted rights for distribution and duplication, if nothing else.

How about this, could i put up something that is my own work but its based on something by someone on the DNP list? Like a cartoon chracter.

I really wouldnt blame the artist or the person who took out the commision.  The fact is its just easier for F-chan that way.  You really cant expect the artist to upload a list of pictures to the mods that say "ok, guys i still want most of my work to be DNP, but if its THIS or THIS from HIM/HER then its ok." thats just unreasonable.

If your talking about the commision that was done its probably fine, otherwise I think it would still be removed just for integrity and ease sake.
